Update to Serious Motor Vehicle Accident Investigation

The Seneca County Sheriff’s Office reports an update to the investigation of a serious motor vehicle accident that occurred on State Route 318 in the Town of Junius on June 23, 2021. Brett Rising, who was operating the Pontiac Vibe, has succumbed to his injuries sustained from the accident and passed away on June 30, 2021 at Strong Memorial Hospital. The operator of the Mercedes Benz, Shyquest K Powell, and a 17 year old female passenger, whose name is being withheld due to her age, are now facing additional charges. It was discovered during the course of the investigation that Powell and the 17 year old had just committed a Grand Larceny at a store located at the Waterloo Premium Outlet Mall. The two then attempted to flee the area traveling eastbound on State Route 318 in a Mercedes Benz at a high rate of speed when they caused the accident with Brett Rising’s vehicle. Powell was previously charged with Reckless Endangerment 1st, Criminal Possession of Stolen Property 3rd, Leaving the Scene of a Personal Injury Motor Vehicle Accident, and other Vehicle and Traffic violations. Powell was ROR’d on those charges but failed to comply with the conditions of her release. As a result, a warrant was issued for Powell for Violation of Pre-Trial Release. On July 12, 2021 at approximately 9:30am Powell was taken into custody on the warrant and was also additionally charged with the following relating to the incident: Manslaughter 2nd (C Felony), Assault 1st (B Felony), Leaving the Scene of a Fatal Motor Vehicle Accident (D Felony), Grand Larceny 3rd (D Felony) and Conspiracy 5th (Class A Misdemeanor). Powell was arraigned at Seneca County CAP Court and remanded to the Seneca County Correctional Facility. On July 13, 2021 at approximately 11:15am, the 17 year old female was issued an appearance ticket for the additional charges of Assault 1st, Grand Larceny 3rd, and Conspiracy 5th. She was arraigned at the Seneca County Youth Part Court and released. Assisting in the arrest of Powell was the Syracuse Police Department.
