Criminal Contempt Arrest

The Seneca Co Sheriff’s Office reports that on 1/4/19 at about 4pm Investigators arrested Edward W. Robinson,28, an inmate at the Seneca Co. Correctional Facility in Romulus for 4 counts of Criminal Contempt 1st degree(class E Felony), 55 counts of Aggravated Family Offense(class E Felony) and 55 counts of Aggravated Harassment in the 2nd Degree(class A Misdemeanor). Investigators report that between the dates of 12/15/18 and 12/18/18 while Robinson was incarcerated in the Seneca Co. Jail, Robinson made 55 phone calls to a female victim who had a class A order of protection against Robinson. Robinson who is currently held in the Seneca Co. Jail on an unrelated matter will be arraigned in CAP Court on 1/4/19 at 7pm.

Criminal Mischief 2nd arrest

The Seneca Co Sheriff’s Office reports that on 1/4/19 at about 3pm Investigators arrested Christopher J. Freeman,31, of 1884 St Rt. 318 for Criminal Mischief 2nd degree(class D Felony), Burglary 3rd degree(class D Felony) and 5 counts of Menacing in the 3rd degree(class A Misdemeanor). Investigators report that at about 4am on 11/25/18 while at Del Lago Resort and Hotel in Tyre, the elevator became stuck and then Freeman and his brother Terrance J. Freeman damaged an elevator and the damage was in excess of $51,000. Terrance J. Freeman was arrested on 11/25/18. Its also reported that Christopher J. Freemen was banned from the property in May of 2018 for an unrelated incident. This resulted in the Burglary charge. During the incident Christopher J. Freemen made threatening statements to 5 security officers of Del Lago leading to the Menacing 3rd in the degree charges. Christopher J. Freeman was held at the Seneca Co. Correctional Facility awaiting arraignment in CAP Court.

Fatal MVA 19SH00364

The Seneca County Sheriff Office reports Sheriff’s Deputies and Investigators responded to a motor vehicle accident that resulted in fatal injuries to a passenger on State Route 96 in the Town of Romulus on 01/08/19 at 4:35 pm. The incident occurred when a 2005 box truck driven by Merlin R. Horst age 35 of 5570 McDuffie Town Rd Romulus, NY was traveling north bound on State Route 96, left the east side of the roadway, and overturned into a ditch. At this point, it is unclear why the vehicle left the roadway. Horst was treated at the scene by South Seneca Ambulance and refused any further medical treatment.  The sole passenger, Enos S. Hertzler, age 19, of 2539 Vineyard Rd, Romulus, NY, sustained fatal injuries as a result of the accident and was pronounced deceased at the scene. Also assisting at the scene was the NYSP Commercial Vehicle Enforcement, NYS DEC, South Seneca Ambulance, Life Net, Romulus Fire, Varick Fire, Ovid Fire and Fayette Fire Departments. Investigators are working closely with the Sheriff’s Office Accident Reconstruction Unit as the accident remains under investigation.  Drugs and alcohol do not appear to be a factor.

Felony DWI arrest

The Seneca County Sheriff’s Office Reports that on 01/04/19 at around 12:30am, Deputies arrested Chad C Weaver, 31, of 4231 Yost Road Waterloo, NY for Felony Driving While Intoxicated. The arrest stems from a traffic stop conducted by Deputies on State Route 96 in the Town of Varick when Deputies observed a vehicle speeding. After pulling the vehicle over, Deputies discovered Weaver to be intoxicated. Weaver was arrested for Felony DWI and Felony DWI with a BAC of .08% or more since he has prior DWI convictions within the past 10 years. He was also issued a UTT for Speeding over the State Speed Limit of 55mph. Weaver was transported to the LEC where he was processed and held for Centralized Arraignment.




Criminal Contempt / Aggravated Family offense arrest

The Seneca County Sheriff’s Office reports that on 12/27/2018 at approximately 8:45 P.M. Sheriff’s Deputies arrested Edward W. Robinson, 28, of 2110 W. Seneca Street Lodi for Criminal Contempt in the 2nd degree, Criminal Trespass in the 2nd Degree and two counts of Aggravated Family Offense. The arrest stems from report of a domestic between Robinson and the victim. Robinson violated a Class A order of protection by being at the protected party’s residence. Robinson was arraigned at the Central Arraignment Court and committed to the Seneca County Jail in lieu of $10,000 Cash or $20,000 bond. He is to reappear to the Town of Lodi Court on 12/31/2018 at 10:00 A.M.



Criminal Trespass arrests

The Seneca County Sheriff’s Office reports that on 12/23/2018 at approximately 8:15 P.M. Deputies arrested Anne E. English, 51, and Kyle S. Armstrong, 25, both residing at 28 North Street Geneva. Deputies responded to a domestic disturbance where English and Armstrong were reported to be trespassing in a residence in the Town of Waterloo. Both were charged with Criminal Trespass in the 2nd Degree. They were arraigned at the Central Arraignment Court and both were ROR’d to appear in the Town of Waterloo Court at a later date. 




On December 26th 2018 at around 3:50 PM Seneca County Sheriff Deputies responded to  the Petro at 1255 State Route 414 for the report of a vehicle that had been driving erratically while on the NYS thruway I90 and almost struck a parked car at another location.  Deputies were able to locate the suspect vehicle and spoke with the driver who was identified as 58 year old Daniel Kavanagh of 1741  Stanley St Cazenovia NY.  After further Investigation Deputies arrested Kavanagh for DWI ,and  Aggravated DWI.  He was taken to the Seneca County Law Enforcement Center for processing and released on appearance tickets.  Kavanagh is to appear in the Town of Tyre Court on January 16th 2019 to answer to the charges.



Update of Suspicious Incident in Ovid

12/24/2018: Seneca County Sheriff’s Office Investigators have located and interviewed the driver of the involved vehicle from the suspicious incident that occurred on December 12, 2018, on South Main Street, in the Village of Ovid. Investigators have determined that this incident is not related to the reported attempted abductions in Geneva. It appears at this time that the Ovid Incident was a misunderstanding exasperated by a language barrier. Sheriff Luce extends his thanks to the many citizens that stepped up to assist in this case by providing information and added safety measures for area children. The Sheriff urges all citizens to continue to immediately report any suspicious incidents of this nature so that they can be investigated in a timely manner.

Update to Suspicious Incident

The Seneca County Sheriff’s Office continues to investigate the suspicious incident that occurred on December 12, 2018 at or about 11:15am on South Main Street in the Village of Ovid. Sheriff’s Investigators have discovered that the suspicious vehicle was a tractor trailer with a maroon power unit and a white trailer with the words of “E-Way Express LLC” on the side. E-Way Express is a nationwide company that is based out of the State of Missouri and Investigators have been in communication with their ownership to determine who the driver was at the time of the incident. The following pictures are also being distributed to the media in an attempt to assist Investigators in determining who the driver was. The male driver was described as a Hispanic male with short brown hair, blue jeans, white t-shirt, and an orange/reddish-colored jacket. Initially, the tractor trailer drove southbound on Main Street through the Village of Ovid and drove northbound through the Village of Ovid about fifteen minutes later. If anyone has information on the identity of the driver, they are urged to call the Seneca County 911 Center at (315) 539-9241. The Sheriff’s Office would like to urge citizens that no criminal charges have been lodged at this time and ask the public not to confront the driver if encountered. If a tractor trailer similar to the one depicted is encountered, the Sheriff’s Office asks that you relay the license plate number, description, and location to authorities. The investigation is ongoing and Investigators are only seeking to interview the driver at this time.

Level 3 Sex Offender- Fail to Change Address

The Seneca County Sheriff’s Office reports that on 12/20/2018 at about 11:00 am, the Road Patrol and Investigators arrested Felix Cruz ,30, of 4455 Co Rd. 50 Canandaigua N.Y. for one count of Failure to Change Address as a level 3 sex offender. This is in violation of the Corrections Law Sex Offender Registration Act.
Investigators report that on November 25th 2018 they were notified that Cruz moved from his residence on 11/21/18 in the Town of Waterloo. After ten days Cruz did not change his address with the Seneca Co. Sheriff’s Office and an arrest warrant was issue on 12/5/18. Cruz was arrested by Ontario Co. Sheriff’s Office at 4455 Co. Rd. 50 the D&D Motel in Canandaigua and turned over to the Seneca Co. Road Patrol division. Cruz was taken to the LEC to await CAP Court for arraignment.
