Press Release - Driving While Intoxicated MVA

Seneca County Sheriff's Office reports, on December 4th, 2013 at 9:32PM Sheriff's Deputies responded to a personal injury motor vehicle accident on Waterloo Geneva Road (NYS Rt 5) (approx 1/2 mile west of Reed Road) in the Town of Waterloo involving a Waterloo Police Department marked patrol unit. Sheriff's Deputies state a westbound vehicle, operated by Josef A. Ufholz, age 71 of 940 Waterloo Geneva Road lot 5 crossed the center line and attempted to make a left hand turn in front of an eastbound Waterloo Police Department patrol unit causing the accident. The Waterloo Police Department Patrolman James B Chechak age 26 of Waterloo suffered a minor head injury and was brought to Geneva General Hospital by a private vehicle for a check over and was released. Ufholz complained of wrist pain and denied medical treatment. A passenger in the Waterloo Police Department vehicle - (a college intern on a ride a long program) was uninjured in the crash. Deputies report that Patrolman Chechak took evasive action in an attempt to avoid the collision, but was unable to, as Ufholz turned into his path. Both vehicles sustained heavy damage and were towed from the scene. Sheriff's Deputies were assisted at the scene by North Seneca Ambulance and the Waterloo Fire Dept, which shut down Rt 5 for approx 3 hours while the Sheriff's Office Accident Reconstruction team investigated the accident. Upon investigating the accident, Sheriff's Deputies arrested Ufholz for Driving While Intoxicated (Felony), DWI Operating with .08 of 1% or more (Felony) and failure to yield the right of way while making a left turn. Ufholz was arraigned in the Town of Waterloo Court and committed to the Seneca County Jail in lieu of $3,500.00 bail/$7,000.00 bond. Ufholz is to reappear in the Town of Waterloo Court on December 9th, 2013 at 0900 for further action.
