Press Release - Arrest in connection with Officer involved shooting - June, 13, 2013

07-09-2013 Seneca County Sheriff’s Investigators arrested Aaron L Russ, 42, of 2945 Pre-Emption Street, Waterloo, N.Y., after being indicted by a Seneca County Grand Jury charging Assault in the Second degree, a class D violent felony.
The indictment and arrest are a result of Russ allegedly assaulting a Seneca County Sheriff’s deputy on June 13, 2013. Russ’s family called the Sheriff’s Office for assistance as Russ was agitated and becoming aggressive. When the Seneca County Sheriff’s deputy arrived on scene he began talking with family members about their concern for Aaron Russ. When the deputy confronted Russ, he then for no apparent reason became aggressive and began striking the deputy repeatedly in the face and head. The deputy deployed a non-lethal taser which had no effect and after repeated blows to his head the deputy was forced to fire two rounds from his service weapon striking Russ in the arm.
After being wounded, deputies rendered first aid to Russ and he was transported to Geneva General Hospital where he was treated and released and taken to the Ontario County Jail on a parole violation warrant. The deputy suffered a concussion and was treated and released from Geneva General Hospital and was placed on administrative leave pending a review of the incident.
Russ was arraigned in Seneca County Court by Judge Patrick Falvey and ordered returned to the Ontario County Jail where he has been held since the incident.
Seneca County Sheriff Jack S. Stenberg reported that he has reviewed all the facts and circumstances surrounding the shooting and has determined that the deputy, who has returned to full duty, followed departmental policy and procedures and the use of deadly physical force was justified.
The Sheriff also reports that the entire case file was turned over to Seneca County District Attorney Barry Porsch for his Office’s review.
