Seneca County Sheriff W. Timothy Luce reports a double fatal single motor vehicle accident that occurred on June 8, 2023, at about 12:54am on Burgess Road in the Town of Waterloo. A vehicle was northbound on Burgess Road traveling at a high rate of speed and left the roadway striking a tree. Prior to the accident, the vehicle was observed in the Village of Waterloo with a traffic violation. A Waterloo Police Sergeant turned his patrol car around in an effort to stop the vehicle for the traffic violation, but the vehicle fled northbound on Burgess Road with its headlights off at a high rate of speed prior to the initiation of the traffic stop.
The driver was identified as Antonio M. Herbert, age 27, of 393 Wagner Street, Lot 29, Waterloo, New York, and the passenger was identified as Egypt G. Harris, age 18, formerly of 1483 West Blaine Road, Romulus, New York. Both Herbert and Harris were pronounced dead at the scene by the Seneca County Coroner’s Office. There were no other occupants in the vehicle and no other vehicles involved.
The New York State Police, Waterloo Fire Department, Border City Fire Department, and North Seneca Ambulance also responded to the scene. The vehicle was demolished and was towed from the scene.
Sheriff’s Investigators are working closely with the Waterloo Police Department, Monroe County Medical Examiner’s Office, and the New York State Attorney General’s Office.
The accident remains under investigation.
Section 70-b of the New York State Executive Law requires that the Office of Special Investigations of the New York State Attorney General’s Office investigates any death that is associated with law enforcement.
